City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
This bill would gradually expand the number of permits to vend food on the streets and sidewalks of New York City. Three hundred new permits, now referred to as supervisory licenses, would be issued each year beginning in 2019 until 2028. Thirty additional supervisory licenses would be issued each year over the same period to veterans, amounting to 10% of the total number. In 2021, the Commissioner of the Department of Health and Mental Hygiene would evaluate the impact of the 990 supervisory licenses issued by that time and whether the continued issuance of such licenses are in the best interest of the city. Depending on the findings of the study, the Commissioner has the discretion to discontinue or reduce the number of supervisory licenses issued in subsequent years.

To address the illegal transfer of permits, the new supervisory licenses requires at least one supervisory licensee to be present at a pushcart at all times. This new requirement will not be applied to existing permits. The bill will also increase the fees for all permits and supervisory licenses.

Importantly, the bill creates a new dedicated vending law enforcement unit, which would exclusively enforce vending laws. It would focus first on those areas of the City with known vending enforcement challenges, and move to all areas as compliance improves.

It would also create a street vendor advisory board, which will include vendors, brick and mortar small businesses, representatives from community groups, labor unions, property owners, and city agencies, to examine the rules for duplicative, unclear, or unnecessary provisions.

The bill would further establish that this priority would not apply where the Commissioner determines that a non-NYCHA property is in need of critical or emergency sidewalk repairs. In these cases, the Commissioner would be required to provide the reasons for this determination in writing to the council member and community board for the council and community district, respectively, where the NYCHA property that loses priority status is located.

This bill would require the Independent Budget Office (“IBO”) to review and evaluate economic development tax expenditures identified by the Council on a schedule set forth by the Council. Such schedule and identification of tax expenditures would be set in collaboration with the IBO. For each economic development tax expenditure reviewed and evaluated, the IBO would submit a report to the Council, and post such report on its website, which would include a description of the data considered and the methodology and assumptions used in such review and evaluation, an analysis of the effectiveness of the tax expenditure and whether the tax expenditure is achieving its intended goals, whether those goals are still relevant, and recommendations for future evaluations. The bill would state that agencies must provide the IBO with the information necessary for IBO to conduct its review and evaluation, and that such agencies must provide IBO and the Council with an explanation when the agencies cannot disclose certain information and include a citation to the laws that prohibit such disclosure. Finally, the bill would also repeal a provision of the Administrative Code that established a tax study commission, which has expired.

This bill would require the New York City Art Commission to submit to the Mayor and the Speaker a report detailing the number of submissions received by the Commission, the number of submissions acted upon, the membership of the Art Commission, a summary of the methods of procedure used to determine the approval or disapproval or rejection of submissions and the number of works of art cleaned, maintained, or repaired, in the previous year.
