City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
The New York City Human Rights Law prohibits anyone who owns, leases, runs or manages a place of public accommodation (such as a store, restaurant, or government agency), or their employees, from denying someone access to the product or benefit being offered to the public for discriminatory reasons. This bill amends that law in two key ways. First, this bill adds three types of people to the list of those who cannot discriminate: anyone who buys or sells a franchise and anyone who leases space to a provider of public accommodations. Second, the bill declares that it is illegal to offer a person who is or is perceived to be a member of a protected class the same benefits, services, or privileges as everyone else, but in such a way that they do not receive “the full and equal enjoyment” of those benefits on “equal terms and conditions,” or to use discriminatory advertisements and public statements. The bill will also make additional minor or technical corrections to the existing law.

A Local Law to establish a temporary program to resolve outstanding judgments imposed by the environmental control board
Summary
This bill would authorize the Commissioner of Finance to establish a 90-day, temporary program to resolve outstanding penalties imposed by the Environmental Control Board in Fiscal 2017. With certain conditions, such program would permit those who are subject to judgments as a result of a default decision to resolve those judgments by paying the base penalty and having the default penalty and accrued interest waived. It would also permit, with certain conditions, those who are subject to judgments as a result of a finding by the ECB that they were in violation to resolve those judgments by paying 75 percent of the imposed penalty and having the accrued interest waived.

After the conclusion of the temporary program, for any judgment that arose from a default decision that was eligible to be resolved as part of the temporary program, the Department of Finance would not be permitted to resolve such judgment by accepting payment of anything less than half of the default penalty and accrued interest.

Summary
In 2013, the Department of Transportation announced that it would replace all 250,000 streetlights in New York City with energy-efficient light-emitting diode (LED) technology by 2017. The correlated color temperature of a streetlight is defined as the perceived color of the light emitted by a lamp, which is expressed in Kelvin (K) units. The color tone can range from warm (yellow and red) lighting to cool (blue) lighting. This bill would require that any lamp installed as part of the lighting of streets, highways, parks, or any other public place have a correlated color temperature no higher than 3000 Kelvin. All new and replacement outdoor lamps would be required to meet this standard.

The proposed legislation would require MOVA to establish at least one Veterans Resource Center in each borough by November 1, 2015. Each center is required to be located in an area easily accessible and in close proximity to public transportation. The Veteran Resource Centers would provide veterans with free, current information on the matters described above, as well as housing, public and private social services, and financial assistance and tax exemptions available to veterans. Additionally, MOVA would be required, beginning May 1, 2016 and every six months thereafter, to submit a report to the Mayor and Council Speaker on the number of veterans utilizing each center, the services offered by each center, those services and/or information most frequently requested by veterans at each center, the number of full and part-time staff working at each center, the amount of funding allocated to each center, and the number of complaints received by each center with a general description of such complaints.

The Administrative Code requires a driver of a motor vehicle to yield to a pedestrian or person riding a bicycle when such pedestrian or person has the right of way. Failure to yield is a traffic infraction, rising to a misdemeanor if injury is caused; however, it is not a violation if the failure to yield and/or injury was not caused by the driver’s failure to exercise due care. Under the bill, in relation to due care, consideration would be given to visibility, illumination, weather conditions, roadway conditions, roadway design, faulty vehicular equipment or design, and whether such pedestrian or person was in violation of any provision of State law relating to the obligations of pedestrians and cyclists at the time of such failure to yield.

Title 8 of the New York City Administrative Code prohibits various forms of discrimination in employment and protects a number of classes of people. Currently, employees of employers with fewer than four employees total are not protected by the prohibitions against discrimination in employment, apprentice training programs, religious observance in the employment context, unemployment status, disparate impact discrimination in the employment context, and unlawful discrimination against victims of domestic violence, sex offenses or stalking. Also, employees of employers with fewer than four employees total are not protected by the Pregnant Workers Fairness Act. This bill would change the definition of employer to provide these protections for domestic workers.

This local law would establish a Small Business Tax Credit (“the credit”) against the Commercial Rent Tax. The credit would provide complete tax relief for taxpayers who have incomes of $5 million or less and who pay less than $500,000 per year in rent. Taxpayers who have incomes of $5 million or less and who pay between $500,000 and $550,000 per year in rent, and those taxpayers who have incomes between $5 million and $10 million and who pay less than $550,000 per year in rent would receive a partial, sliding scale credit. Taxpayers who have incomes of more than $10 million would not receive any credit. The credit would be available beginning July 1, 2018.

This bill would require the Department of Finance to include a notice regarding legal and preferential rents on certain documents related to the NYC Rent Freeze Program. Specifically, the notice must include the rent amount on which the benefit calculation was based, an explanation of why that amount was used in the calculation, the legal regulated rent, an explanation that the tenant may continue to pay a preferential rent even once enrolled in the program, a statement that the tenant can obtain a rent registration history and file a complaint with the State Division of Housing and Community Renewal, and a telephone number and email address for that agency.

In addition, by 2018, the legislation would require the Department of Finance to include both the preferential and legal regulated rents of applicants to the NYC Rent Freeze Program in its database and include the preferential rent amount in the notice described above.

A Local Law in relation to creating a taskforce to study veterans in the criminal justice system
Summary
This bill would establish a task force to study the issues confronting veterans involved in the criminal justice system, and issue a report with recommendations on how to limit the involvement of veterans in the criminal justice system, assist veterans transitioning out of the criminal justice system, expand available legal services for veterans, and other recommendations as the task force determines appropriate. The task force would consist of the Mayor’s Office of Veterans’ Affairs, the Mayor’s Office of Criminal Justice, the Department of Correction, the Department of Probation, the Police Department, and two appointees each by the Mayor and Speaker of the Council. Additionally, the bill would require the task force to make a good faith effort to procure certain information regarding veterans in the city’s criminal courts, and would require the Department of Correction to provide certain information on incarcerated veterans in the city to the task force for inclusion in the report. The task force would be required to issue the report, including recommendations, no later than July 1, 2016.

The bill would require the Human Resources Administration to provide rental assistance to disabled veterans residing in apartments with rents at or below the fair market rent amount set by the United States Department of Housing Urban Development. To qualify for the rental subsidy a veteran would have to receive a disability pension from the United States Department of Veterans Affairs (VA) or receive service-connected disability benefits from the VA at a 50 percent or higher disability rating. In addition, the veteran’s combined earned and unearned income could not exceed 200 percent of the federal poverty level and resources could not exceed the limit for public assistance recipients under New York State Law. Veterans who meet these qualifications would be required to pay no more than 30 percent of their monthly income toward their rent.

This bill would impose a mandatory public review process for all applications for certificates of appropriateness filed with the Landmarks Preservation Commission (LPC). It would require LPC to refer all applications for certificates of appropriateness to affected community boards after they are filed with the commission. It would require LPC to wait to hold its required public hearing on the application to allow a sufficient amount of time for the affected community board to review and comment on applications. The bill also would require an additional, second community board referral and notification to the local councilmember when an application is significantly modified after LPC holds its public hearing on the application. A modification would be considered significant if it resulted in:

1. Any change in the footprint of the proposed improvement,
2. Any increase in the height of the proposed improvement, or
3. Any significant change in the exterior design elements or materials

Lastly, the bill would require LPC to notify both the community board and the local councilmember if the Commission made further modifications to the proposal after a second community board referral.

Summary
For purposes of this legislation, the term “press vehicle” means a registered motor vehicle which contains a license plate issued by the Department of Motor Vehicles indicating that the registration was provided to a member of the press, or a vehicle registered by the New Jersey Motor Vehicle Commission or the Connecticut Department of Motor Vehicles in a series reserved for members of the press working in New York State.

The proposed legislation would permit press vehicles to park where parking or standing is otherwise prohibited (except where prohibited to all motor vehicles) and would provide that they are not required to use an authorized payment method for a metered parking space or comply with any sign indicating a time limit for such metered parking. These rules would apply only if at the time of parking the operator or any occupant of the vehicle is actually engaged in the covering of a news event or a matter of public concern. Finally, the proposed legislation would establish that where any city agency has granted by sign any parking or driving privilege to “vehicles with NYP license plates,” such privilege is extended only to press vehicles and on-duty emergency vehicles.

The Department of Correction is currently required to report on certain conditions in their punitive segregation facilities and other specialized facilities in which inmates are punished for committing certain infractions while in custody. This bill expands the list of facilities for which such reporting is required, adding any facility in which inmates are regularly kept to their cells for more than the maximum number of hours allowed by the jail standards, regardless of whether such placement is due to a punishment for committing an infraction or not. This would mean that the Department’s new Enhanced Supervision Housing would be included in this reporting requirement.

Summary
The Department of Correction operates a grievance system in which inmates may file formal complaints regarding the conditions of incarceration, pursuant to state mandates. This system has multiple levels of review, from the initial filing of the grievance through multiple phases of review and appeal. Grievances may be filed through a grievance office or through a box in which grievance forms may be deposited.

This bill requires the Department to report on the number of grievances filed at every step of the grievance process, and the outcome of such grievances at each state of the grievance system. The bill also requires the Department to list separately the system’s functioning in those facilities in which grievance offices or grievance form deposit boxes are not available, and to list separately whether grievances are filed through the grievance office, the grievance form drop box, or through grievance program staff members.
