City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
This bill requires the Department of Correction to work in conjunction with the Department of Health and Mental Health to develop a “crisis intervention program.” This program would be designed to address situations in which inmates with mental health issues act out, typically by refusing to leave their cells or disobeying correction officers. The program would create protocols to address these issues. The bill also requires the Department of Correction to provide specialized training in how to address such situations, and to create a policy of addressing these situations with teams of officers with such training. These teams would also be required to include one civilian associated with the Department of Health and Mental Health who has received specialized training on addressing these situations. The Departments of Correction and Health and Mental Health must meet at least yearly to address issues with the crisis intervention program.

The bill also requires the Department of Correction to report yearly on the status of this program, including the number of officers who have received crisis intervention training, the number of crisis intervention teams utilized by the department, and the number of crisis situations involving inmates with mental health issues were addressed with such teams.

Summary
The Department of Health and Mental Health (“DOHMH”) oversees the health care of all inmates in the custody of the Department of Correction (“DOC”). This bill requires the DOHMH to review all treatment of inmates for particularly serious injuries, including injuries to the head or other serious physical injuries. The DOHMH would be required to report all such injuries to agencies that have the authority to investigate them: the Board of Correction, the Department of Investigation, and the Investigative Division of the DOC. The bill would also require the DOHMH to report on the number of such injuries they treat on a quarterly basis.

The bill would also require the Investigation Division of the DOC to investigate all such injuries, and to report on the outcomes of these investigations at every step of the process, including any disciplinary steps taken against staff who cause such injuries. The bill also requires the DOC to report on the number of such injuries that are incurred by inmates on a quarterly basis.

The bill also imposes parallel reporting requirements for incidents in which inmates assault Correction staff: the DOC must report on all injuries and serious injuries incurred by staff due to an assault by an inmate on a quarterly basis, must refer all such physical injuries to the Investigation Division of the DOC, and must refer all such serious injuries to the District Attorney’s office with jurisdiction over the alleged assault. The DOC must also make a good faith effort to obtain information from the District Attorney regarding the outcomes of any such referrals.

This bill would impose a timeline on designation of landmarks, interior landmarks, scenic landmarks, and historic districts. For individual landmarks, the bill would require the Landmarks Preservation Commission (LPC) to designate a property as a landmark within one year of calendaring the property for consideration, with the option for a one year extension with owner consent. For historic districts the time period would be two years from the time the property is calendared. Lastly, the bill would require LPC to make a determination on whether to designate items (both individual landmarks and historic districts) that are currently on the calendar within 18 months of the effective date of the local law.

In all cases, if LPC disapproves or fails to designate any item, the property in question would be automatically removed from the calendar.

Summary
This bill requires the Department of Information Technology and Telecommunications (“DoITT”) to report on a number of issues pertaining to the inmate population of the Department of Correction (“DOC”). The bill would require DoITT to report information on a quarterly basis regarding the number of inmates in DOC’s custody, based both on the average daily inmate population for the quarter and for the total number of inmate admissions that quarter. For those inmates detained pre-trial, the following information must be reported: the charges they are facing, how serious those charges are, how long these they have been detained, how much bail has been set on them, and their criminal record if any. For those inmates who were sentenced, DoITT must report the length of these inmates’ sentences.

The bill also requires DoITT to report on the court system’s impact on the DOC inmate population. For both felony and misdemeanor cases, DoITT must report the number of cases in which bail was set and the number of cases in which the defendant failed to appear for a court date, both for cases in which the defendant posted bail and for cases in which the defendant was released. The bill also requires DoITT to report on the number of cases in which defendants were released under specified conditions such as supervised release programs, the number of cases in which forms of bail other than cash or bail bonds are imposed, and the number of defendants who post bail. Finally, the bill requires DoITT to report on the outcomes of cases in which defendants are incarcerated pre-trial, and to report certain key information differentiating between boroughs, and comparing that borough-specific data to borough-specific crime rates.

Currently, the Administrative Code requires the New York City Department of Transportation (DOT) to inspect locations where four or more serious injuries or fatalities of cyclists or pedestrians occurred and to make results of such inspections available to the public upon request. Under the bill, DOT would be required to submit such results to the relevant Council Member and Community Board. The bill would also require that DOT accelerate the timeframe in which it conducts comprehensive studies of pedestrian fatalities and serious injuries from every five years to every three years. Additionally, such studies would be required to be submitted to Community Boards.

Summary
Title 20, Chapter 5, Subchapter 14 of the New York City Administrative Code regulates Immigration Assistance Service Providers. This bill would amend Subchapter 14 to impose stricter guidelines for providers and further protect customers against immigration services fraud and unauthorized practice of the law. Providers would be required to include specific language in their contracts related to the provider’s duties and limitations, as well as the customer’s rights. Additionally, providers would have to post required signage in English, as well as in any languages in which they provide or offer to provide services. Providers would be prohibited from offering and providing services that should only be provided by an attorney, and from making statements that could lead a customer to believe that the provider is an attorney or an immigration expert. Additionally, this bill would require that the Department of Consumer Affairs (DCA) provide periodic reports to the Council with information regarding the number, type, source and result of complaints against providers.

Summary
Various provisions in the New York City Charter (the “Charter”) prescribe the actions that need to be taken as part of the annual budget submission process during a fiscal year. Such provisions also prescribe dates on which these actions must be taken. This legislation would amend the Charter prescribed dates for Executive budget action. The new dates are as follows:

1. Mayor’s submission of the proposed executive budget and budget message no later than May 7, 2015.

2. Mayor’s submission of the Ten-Year Capital Strategy no later than May 7, 2015.

3. Borough Presidents’ submission of recommendations in response to Mayor’s executive budget no later than May 15, 2015.

4. Director of Independent Budget Office’s submission of report analyzing the Mayor’s executive budget no later than May 26, 2015.

5. Completion of City Council’s executive budget hearings no later than June 15, 2015.

6. If an expense budget has not been adopted by June 16, 2015, the expense budget and tax rate adopted as modified for the current fiscal year shall be deemed to have been extended for the new fiscal year until such time as a new expense budget has been adopted.

7. If a capital budget and capital program have not been adopted by June 16, 2015, the unutilized portion of all prior capital appropriations shall be deemed reappropriated.

8. Mayor’s submission to Council of an estimate of probable amount of receipts no later than June 16, 2015.

9. Any person/organization’s submission of an official alternative estimate of revenues no later than May 26, 2015.

10. If the Council has not fixed the tax rates for the ensuing year on or before June 16, 2015, the Department of Finance is authorized to complete the rolls and collect property tax using estimated rates.

11. If the Council has not fixed the tax rates for ensuing fiscal year on or before June 16, 2015, the Council shall fix the tax rates for ensuing fiscal year at percentages differing from the estimated rates, and property tax payments shall be paid at the estimated rates. In this event DOF must revise the assessment roll before January 1st and send out an amended bill to reflect the tax rates fixed by the Council.

This bill would require covered developers to submit workforce disclosure records to an agency designated by the Mayor on the number of hours worked, job title, full or part-time designation and gross wages of individuals working on covered projects. Covered developers would also need to provide workforce disclosure records for the gender and race or ethnic group of employees when such information is voluntarily provided for the purpose of reporting to the city.

By no later than October 31, 2021 the mayoral agency designated to administer this program would be required to make such information available online only when it could be sufficiently anonymized, and, beginning no later than October 31, 2022, publish such information in a report every five years.

Such records would be required to include: 1) the date, time, and location of the pick-up and drop-off; 2) the driver’s TLC license number; 3) the dispatched vehicle’s TLC license number; 4) the TLC license number of the base that dispatched the vehicle; 5) the TLC license number of the for-hire affiliated to the dispatched vehicle; 6) the fare collected; and 7) whether the trip was in response to a request for a wheelchair accessible vehicle. Bases that fail to adhere to trip record requirements would be subject to civil penalties of $200 to $1,000 per record not collected and transmitted. The TLC would also be required to post on its website and submit to the Council summaries of such trip records biannually, beginning December 1, 2015.

Section §14-150 of New York’s Administrative Code, requires the New York City Police Department to provide to the Council various statistical criteria relating to the operation of the NYPD. Paragraph (4) in particular, requests the total number of arrests, crime complaints, arrests, summons activity, domestic violence radio runs and felony complaints for properties under the jurisdiction of the department of parks and recreation. Each of these requests requires a further breakdown in areas such as level of crime, precinct where crime occurred, transit district and other useful categories that assist in providing the council with a more detailed understanding of the requested information. This amendment would require the NYPD to report on the number of voided arrests as well as the number of arrest which were declined by the local prosecutor providing a broader picture of NYPD statistics.

Inspected businesses are directed to this customer service survey when they are handed a “Business Owners Bill of Rights,” which is required to be distributed during inspections. The bill would further require that, if fewer than 500 survey responses are received during designated two-year periods, the Office of Operations would be required to conduct outreach until that number is met for up to three months.

The bill would also require that the standardized customer service training curriculum developed by the Mayor’s Office of Operations for training agency inspectors include specific protocols for inspectors to follow when interacting with non-English speakers to ensure that such inspectors provide language translation services during inspections.

During heating season, between October 1 and May 31, owners of residential buildings who are required to provide heat for their tenants must maintain certain minimum temperatures in areas of dwelling units that are used or occupied for living purposes. This bill would increase the minimum nighttime (between 10 p.m. and 6 a.m.) temperature during heating season from 55 degrees to 62 degrees, regardless of the outdoor temperature.
