City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
The Department of Correction (“DOC”) houses inmates in a variety of facilities, some on Rikers Island and others in various borough facilities. This bill requires the DOC to publish a quarterly report on the number of visitors in both Rikers Island and in borough facilities, and to differentiate between attorney visits and other types of visitors. The bill also requires the DOC to report the number of visitations in which the visitor unable to visit their inmate, and to record and report the reason the visit was unsuccessful. The DOC must report the total number of visits and the rate of visits per inmate. All reporting differentiates between Rikers Island and borough facilities.

Under the current NYC Administrative Code, home improvement licensees, when doing home repair or home improvement work, are restricted from facilitating certain financing for that work. Specifically, they are prohibited from acting as an agent for a lender and from advertising, promoting or otherwise arranging for the services of a lender.

This bill would remove the prohibition on advertising, promoting or otherwise arranging for the services of a lender but would maintain the prohibition on acting as the agent of a lender and prohibit the advertising or promoting of a single lender.

Summary
Currently, New York State law contains several criminal penalties for the theft of a motor vehicle or bicycle under statutes prohibiting larceny and unauthorized use of a vehicle.

The proposed bill would institute a civil penalty for any individual convicted under the Penal Law for larceny of a bicycle or motor vehicle, or the unauthorized use of a vehicle. For theft of a bicycle, the amount of the penalty would be between $500-$1,000 per bicycle, and for theft of a motor vehicle, the amount of the penalty would be between $5,000-$7,500 per vehicle. These penalties would be recoverable at the Environmental Control Board, and would be an addition to or as an alternative to any criminal penalties authorized by law. The civil penalty would also not limit any cause of action available to an individual or entity aggrieved by the acts applicable to this section.

Summary
The City of New York maintains air conditioned cooling centers throughout the City that are available to members of the public during a heat-related emergency. The program is operated by the Office of Emergency Management (OEM) in conjunction with the Department of Health and Mental Hygiene (DOHMH). These centers include senior centers, community centers, and libraries. Throughout the year, the City monitors the heat index, which calculates the apparent temperature of the environment based on the actual temperature and the humidity. When the heat index reaches a certain level, the City issues a heat advisory to indicate a heat-related emergency. During such heat-related emergencies, the City opens cooling centers so that the people may seek relief from the outdoor environment.

The proposed legislation would codify the City’s cooling center program, requiring them to be open during heat-related emergencies and expanding the program to days when the AQI indicates that the air quality poses health risks to vulnerable populations. The legislation would grant DOHMH, in conjunction with OEM, the discretion of designating the number and location of cooling centers, but would require that there be no fewer than the median number of cooling centers operated during heat-related emergencies in 2014. In designating such centers, the agencies would have to take into account where vulnerable populations reside and where such populations would be likely to use centers. In addition, DOHMH would be required to post information about the cooling center program on its website with a list of the cooling centers that will be available, and would also have to conduct a public education campaign to increase awareness of cool centers and the risks associated with heat-related emergencies and poor air quality. Finally, DOHMH would have to conduct an annual survey on utilization of the program and submit a report annually to the Mayor and City Council on the program.

Summary
This bill would create a disconnected youth task force to examine the challenges that prevent disconnected youth from enrolling in school or being employed. The task force would be composed of 25 members including the following city agencies, DYCD, SBS, DOE, ACS, DOP, HRA, DOHMH, and DHS. Other members include the Deputy Mayor of Strategic Policy Initiatives, the Mayor’s Center for youth Employment, and the Office of Workforce Development. Additionally, the Mayor will appoint six members and the Speaker of the City Council will appoint five members.

Members of the taskforce will be appointed within 30 days of enactment of this law. The taskforce will provide the Mayor and the Speaker with a report that includes, but is not limited to, an analysis of what obstacles prevent disconnected youth from enrolling in school or being employed, the education and skills employers require, and the policies and programs that affect disconnected youth. The task force will also provide recommendations on how the City could better serve this population. The taskforce will submit its first report on March 1, 2018, and then biennially thereafter. The task force will cease to exist after submitting its final report on March 1, 2022.

Summary
This bill adds notice requirements with respect to an owner’s right of access. Specifically, this bill requires an owner to provide a tenant with written notice before entering such tenant’s dwelling unit for inspections or repairs or improvements. The bill requires notice to be delivered by personal delivery and email, if the tenant has provided the owner with an email address, at least 72 hours before making an inspection and 14 calendar days before making repairs or improvements or doing other work within the dwelling unit. The notice period is waived if the tenant gives consent that the owner may enter the dwelling unit at an earlier time or if the repair, improvement or work is being done at the request of the tenant.

The bill also prescribes the content of the notice. The notice must be dated and include the date and the time that the owner wishes to enter the dwelling unit, a contact phone number for the owner, the name of the person delivering the notice, a statement of the reason for entering the dwelling unit, and a statement that the tenant can waive the notice period. The bill requires such notice to be in English and Spanish, and another language if the tenant cannot meaningfully communicate in either English or Spanish.

There have recently been several reported incidents of building owners hiring tenant relocation specialists to try to convince tenants, many of whom are rent-regulated, to leave their apartments. This bill would create a licensing scheme for tenant relocation specialists and agencies which would require applicants to pass an exam, furnish a surety bond, pay a licensing fee and make initial contact with tenants in writing. It would also bar licensees from harassing tenants or providing false information to tenants. Finally, this bill would require the Commissioner of the Department of Consumer Affairs to provide an annual report to the Mayor and the Council on the implementation of this law.

In 2010, the City released a report estimating that by 2030, 44 percent of the City’s greenhouse gas emissions will come from the transportation sector. The report recommended the City encourage use of electric vehicles (EVs) to help reduce emissions, improve air quality, and save drivers money on fuel and maintenance. In 2013, the Council passed a local law requiring that 20 percent of parking spaces in new parking garages and open parking lots be capable of supporting EV charging stations. Existing lots were also required expand EV charging capabilities as they upgrade their electrical capacities.

Under the proposed local law, 40 percent of parking spaces in new parking garages and open parking lots must be capable of supporting EV charging stations by January 1, 2030. Existing lots would also be required to expand EV charging capabilities as they upgrade their electrical capacities.

Laundries in the City are licensed by the Department of Consumer Affairs (“DCA”). The current licensing scheme dates from the early 20th Century and certain activities are not properly regulated. This bill would update the City’s laundry licensing law to better regulate the industry as it operates today. The bill would create a tiered licensing scheme to capture three distinct activities: retail laundry, industrial laundry and industrial laundry delivery. This bill would create additional requirements related to cleanliness and hygiene for industrial laundries and industrial laundry delivery services. Industrial laundries would be required to implement procedures to ensure that all laundry is hygienically cleaned and, businesses engaged in industrial laundry delivery would be required to implement procedures to ensure separation of clean and dirty laundry in order to maintain cleanliness. Finally, this bill would create a task force to review the industry and the enforcement of the law and make any recommendations to the Council and the Mayor.

The Administrative Code of the City of New York (the “Code”) defines a newsrack as “any self-service or coin-operated box, container or other dispenser installed, used or maintained for the display, sale or distribution of newspapers or other written matter to the general public.” Currently, the Code regulates where newsracks may be placed, installed, or maintained. Thus, the Code places restrictions in several locations in which the placement of newsracks would present safety concerns to persons and property.

The proposed bill would prohibit the placement, installation, or maintenance of newsracks within three feet ahead or 25 feet to the rear of any designated taxi stand. Furthermore, it provides that the law would take effect 90 days after enactment into law, but authorizes the Commissioner of the Department of Transportation to take actions necessary to implement the law prior to its effective date.

Dealers in possession of motor vehicles awaiting repair or return to the owner or lessee would be required to display a placard indicating the dealer’s name, address, license number, and telephone contact information in a manner clearly legible through the motor vehicle’s forward windshield. Each violation of these prohibitions would be punishable by a fine of no less than $250 and no more than $400. Every day that a motor vehicle is parked illegally would be considered a separate violation.

Additionally, the bill would allow the owner or lessee of a motor vehicle who receives a summons for a parking violation on a date and time in which the dealer was in the possession of the motor vehicle to use the dealer’s possession as an affirmative defense. If this defense is successful, the Transportation Commissioner may issue a summons, violation, or otherwise prosecute the dealer in possession at the time of the offense.

The bill would also make any motor vehicle parked upon any city street for the purpose of displaying the motor vehicle for sale or greasing or repairing such motor vehicle (except in the case of an emergency repair) subject to impoundment. Any motor vehicle impounded would not be released until all applicable towing and storage fees were paid. If a motor vehicle is impounded or receives a summons while in possession of a dealer who is not the owner or lessee of the vehicle, the bill permits the owner or lessee of the vehicle to maintain a private cause of action against the dealer in possession.

Summary
This bill would codify in the Administrative Code the submission requirement that currently exists in the Health Code. It would require DOHMH to post documentation of annual inspections on its website and the City’s Open Data portal, to provide guidance on its site to assist users in determining whether a building is required to have a water tank inspection, and to post information on how to submit a complaint about a water tank or water from a water tank to DOHMH. This bill would also reinstate a lapsed requirement of annual reporting by DOHMH to the Council relating to water tank inspections, and introduce a new requirement that such reports include data on the number of inspection results received, including the number of received results that demonstrate compliance with the health-related requirements for water tanks.
