City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
This bill would require the Department of Health and Mental Hygiene (DOHMH) to provide every student at every college in the City with information about services regarding sexual assault, including how to contact rape crisis centers, hospitals with forensic examiner programs, and telephone help lines. It would require DOHMH to provide all students with an online tool with functionality for reporting sexual assaults and where they have occurred. It would require the DOHMH to develop a sexual assault prevention and response curriculum that would include training in affirmative consent and on-campus adjudications for students, faculty, campus safety officers and college administrators. Lastly, it would require DOHMH to establish a task force including representatives from certain City agencies to work with students and representatives of the faculty and administration from colleges and universities in the City to identify ways to improve City services and agency responses to college sexual assaults.

Summary
This bill requires secondhand automobile dealers to disclose recall information to consumers when selling automobiles, parts or equipment that are the subject of a recall by the national highway transportation safety administration or the NHTSA. Such disclosure, which would be signed by the purchaser, would be retained by the dealer for five years, and subject to inspection by the Department of Consumer Affairs. This bill would impose a $1000 fine for a first offense, a $1000 fine or imprisonment for a second offense, and suspension or revocation of a dealer’s license at the discretion of the commissioner for any subsequent offenses during a three year period.

This bill would require landlords to provide building occupants with two weeks’ notice prior to making a building amenity unavailable if the amenity will be unavailable for more than twenty-four hours, excluding periods during which the amenity is normally unavailable. The notice would have to be posted in a prominent place in the building, identify the amenity which is to be made unavailable and state the expected duration of its unavailability. Where an amenity will be permanently unavailable, the notice must remain posted for at least 30 days after the amenity becomes unavailable. Building amenities made unavailable on an emergency basis would be exempt from the notice requirement. This bill would also require HPD to publish rules regarding what constitutes an emergency basis.

Introduction No. 511-A would require the Department of Education (DOE) to submit to the City Council and post on its website, an annual report regarding student demographics and the DOE’s efforts to encourage diversity within schools. The bill would require the DOE to report this demographic data for students for each community school district, each school within a district, and each program within a school.

Introduction No. 511-A would also require the DOE to report on any efforts during the preceding school year to encourage a diverse student body in its schools and special programs, including; strategic site selection of new schools and special programs, considering demographics of neighborhoods when drawing attendance zones, and targeted outreach and recruitment efforts.

Summary
This bill would create an Advisory Board relating to the effectiveness and implementation of the gender marker change requirements in Proposed Introduction Number 491-A and the New York City Health Code. It would require the Advisory Board to issue a report concerning the requirement and recommendations for changes and/or improvements, if any.

The Board would consist of seven members, with the Commissioner of the Department of Health and Mental Hygiene (DOHMH) appointing four members, and the Speaker of the City Council appointing the remaining three. The Board members would include advocates for transgender people, licensed medical or mental health professionals who are permitted to make attestations pursuant to the gender marker requirement, and a senior staff person in DOHMH working on transgender and/or lesbian, gay, bisexual and transgender issues.

The Board would meet no less than every three months, and would assess the gender marker change requirement, including transgender people’s access to professionals who can complete the attestations for gender marker change applications, utilization of the amendment process, the number of applicants, processing time for applications and the requirement’s impact on transgender people. The Board would also make recommendations for improvements, if any, to the gender marker change requirement, including, but not limited to, best practices among policies for gender marker changes, and actions taken by DOHMH in response to such recommendations.

The Board would be required to submit a report to the Mayor, the Commissioner of DOHMH and the Speaker of the Council on or before March 1, 2017 covering the subjects of the Board’s meetings.

Summary
The New York City Health Code currently allows individuals to change the gender designation on their birth certificate if they have obtained a court order changing his or her name and undergone “convertive surgery.” This bill would allow individuals to change such gender designation by having a medical or mental health professional fill out an affidavit or affirmation attesting that the changed sex designation more accurately reflects the applicant's sex gender identity.

The licensed professionals allowed to make such attestations would be as follows: physicians, doctoral level psychologists in clinical or counseling psychology, clinical social workers, master social workers, physician assistants, nurse practitioners, marriage and family therapists, mental health counselors or midwives. Such practitioners must be licensed to practice in the United States, and must include a declaration under penalty of perjury that the professional is licensed and in good standing and that the applicant’s requested correction of sex designation more accurately reflects the applicant’s sex or gender identity.

The federal Immigrations and Customs Enforcement Agency (“ICE”) files an “immigration detainer” with the New York City Police Department (“NYPD”) when they believe an individual in NYPD custody is subject to removal from this country. The immigration detainer serves as a request that the NYPD detain the individual for up to 48 hours beyond when the individual would otherwise be released so that the individual’s custody may be transferred to ICE. This bill would significantly restrict the conditions under which the NYPD complies with these ICE requests. The NPYD would only honor an immigration detainer if it was accompanied by a warrant from a federal judge, and also only if that person had been convicted of a “violent or serious” crime during the last five years or was listed on a terrorist database.

The bill would also allow the NYPD to honor an immigration detainer even if not accompanied by a judicial warrant if the subject had been convicted of a “violent or serious” crime or is a possible match on the federal terrorist watch list and had previously been deported.
