City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

This bill would abolish the police department’s Criminal Group Database (Database) and prohibit the establishment of a successor database with the same or substantially similar features. Pending the ultimate destruction of records in the Database, no employee of the city would be permitted to access the Criminal Group Database for law enforcement purposes. The Inspector General for the Police Department would be required to notify persons named in the Database and provide additional information regarding how persons may submit requests for records contained in the Database, pursuant to the State Freedom of Information Law, prior to the destruction of such records. Violations would be enforced by the Inspector General for the Police Department and punishable by civil penalties. In addition, persons aggrieved by a violation would have a private right of action to seek damages and other relief.

Current law requires a new or amended Certificate of Occupancy (“CO”) when a building or lot undergoes a change from one occupancy or zoning group to another, or is being changed in a manner inconsistent with the existing CO. This bill would provide an exception from the requirement to obtain a new or amended CO, in the case of certain hotels built on or before July 1, 1969 that had been used for transient purposes but subsequently are to be occupied by longer-term, rent-stabilized tenants. This exception would apply regardless of whether a tenant acquired rent stabilized-status after occupying a unit, or was offered a lease in advance of occupying the unit.

This local law would take effect 120 days after it becomes law, provided that this local law shall not apply to any project, tenancy, subtenancy, lease, sublease, contract or subcontract entered into prior to the effective date of this local law.

This bill would require the Mayor to establish an Office of Community Mental Health (OCMH) within the Executive Office of the Mayor, or as a separate office, or within any other agency or office headed by a mayoral appointee. OCMH would be charged with the following duties and operations: request and receive the assistance of any other agency or office; develop and support the implementation of strategies to close gaps in mental health care; develop interagency policies and practices to promote mental health; decrease any barriers to mental health care that may prevent access among groups identified as being under-served; and perform any other relevant duties as the mayor may assign. Additionally, OCMH would be responsible to ensure interagency coordination with DOHMH or any other office or agency. This bill would also require the establishment of a Mental Health Council to advise OCMH on issues relating to mental health and mental health care and facilitate coordination and cooperation among city agencies. Finally, OCMH would be required to annually report to the Mayor and Speaker of the Council, and post to OCMH’s website, a report identifying critical gaps in mental health care that are preventing New Yorkers with mental health needs from accessing and staying connected to care.

Summary
This bill would amend the City’s Earned Safe and Sick Time Act. Under the bill, an employee who is a parent or legal guardian of a child would be entitled to four hours of COVID-19 child vaccination time per vaccine injection for each child. The parent would be permitted to be absent to accompany their child to receive the vaccine, or care for the child due to side effects from the vaccine. COVID-19 child vaccination time would be paid at the employee’s regular rate of pay and would be in addition to the employee’s accrual or use of existing safe/sick time. It would be required to be paid by the next regular pay date. An employer could require that within seven days an employee provide documentation that their child was vaccinated. An employer could not require the employee to work additional hours to make up for the original hours the employee was unavailable, or find a replacement employee to cover the their hours, because the employee used COVID-19 child vaccination time. The bill’s requirements could not be waived, notwithstanding certain collective bargaining agreements. The bill would provide for relief and penalties for a failure to provide COVID-19 child vaccination time. It contains a 60-day phase-in period during which the Department of Consumer and Worker Protection would give written notice and a cure period before enforcing against employers who do not provide the new COVID-19 vaccination leave. The bill would expire and be deemed repealed on December 31, 2022.

This bill would require the Police Department (NYPD) to train officers on responding to incidents involving domestic violence, sexual crimes, or human trafficking. The training would be developed from recommendations made by an interdisciplinary, interagency committee consisting of representatives of the NYPD, the Mayor’s Office to End Domestic and Gender-based Violence, the Mayor’s Office of Criminal Justice, domestic violence service providers, sexual assault service providers, and human trafficking service providers. In addition, the bill would add such service providers to the City’s domestic fatality review committee and create a fatality advisory committee to review individual case level data on gender based and domestic violence fatalities.

This bill would require the Department of Education (DOE) to report on its website, every two weeks, positive COVID-19 cases among administrators, teachers, students and other school staff in every DOE school. The reporting would also include which schools have been closed due to COVID-19 and the number of classrooms that have been closed due to COVID-19. The DOE would also be required to report on the number of administrators, teachers, students and other school staff who have been fully and partially vaccinated for COVID-19. The student reporting metrics would, to the extent such information is collected, is to also reported on a monthly basis in a disaggregated way by grade level, gender, race or ethnicity, individualized education program status, English language learner status, status as a student residing in shelter and status as a student in temporary housing that is not a shelter.

The Zoning Resolution established the Inclusionary Housing Program and other affordable housing programs to ensure that the housing marketplace serves New Yorkers at a broader range of income levels. These affordable housing programs promote economic integration in areas of the City undergoing substantial new residential development by requiring a portion of the housing developed be permanently affordable to provide for long-term stability and economic diversity in neighborhoods. This bill authorizes the Department of Housing Preservation and Development to enforce the affordable housing provisions placed within its responsibility in the Zoning Resolution, and provides procedures by which enforcement is to take place. Without this authorization, the city would be limited in its ability to ensure that the Zoning Resolution’s affordable housing programs are serving their purpose and would lack the ability to penalize those who would cheat the system.

A Local Law to amend the administrative code of the city of New York, in relation to agency actions and licensee disclosures in the event of a breach of security
Summary
This bill would amend the City’s data breach notification laws to align them with requirements in New York’s SHIELD Act. It would make certain definitions in City law more consistent with State law. City agencies that have suffered a security breach involving persons’ private identifying information would be required to promptly disclose it to the City’s Chief Privacy Officer, the Office of Cyber Command, and the Department of Information Technology and Telecommunications; formerly the NYPD received this type of disclosure. The obligation to make this type of disclosure – including to affected persons – would be expanded to situations in which the information was reasonably believed to have been accessed, disclosed or used by an unauthorized person. With some exceptions, the bill would mandate that if 5,000 or more New York residents must be notified at one time pursuant to Section 10-502 of the City’s Administrative Code, the notifying agency must also notify consumer reporting agencies as to the timing, content and distribution of the notices, and approximate number of affected individuals. Certain agencies would have to coordinate and keep records on data breaches. The bill would mandate that Department of Consumer and Worker Protection, Department of Health and Mental Hygiene and Taxi and Limousine Commission licensees required to make a data breach notification pursuant to State law, promptly submit a copy of the notification to their licensing agencies.
