City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

This bill would require the Department of Education (DOE) to publicly post, daily, on their website attendance data aggregated citywide and disaggregated by school for the previous day and previous week. The DOE is also required to publicly post, every two weeks, in the aggregate and disaggregated by school: * the number of students partially vaccinated for COVID-19 in attendance; * the number of students fully and partially vaccinated for COVID-19; * the number of COVID-19 testing consent forms received from families; * the number of consent forms withdrawn; and * the number of unvaccinated students required to quarantine because of exposure in school to an individual who tested positive for COVID-19. The data, to the extent such information is collected, would be disaggregated by grade level, gender, race or ethnicity, individualized education program status, English language learner status, status as a student residing in shelter and status as a student in temporary housing that is not a shelter.

Summary
This bill would require the Department of Education (DOE) to report on its website, every two weeks, positive COVID-19 cases among administrators, teachers, students and other school staff in every DOE school. The reporting would also include which schools have been closed due to COVID-19 and the number of classrooms that have been closed due to COVID-19. The DOE would also be required to report on the number of administrators, teachers, students and other school staff who have been fully and partially vaccinated for COVID-19. The student reporting metrics would, to the extent such information is collected, is to also reported on a monthly basis in a disaggregated way by grade level, gender, race or ethnicity, individualized education program status, English language learner status, status as a student residing in shelter and status as a student in temporary housing that is not a shelter.

Summary
This bill would authorize the use of pay-by-plate parking meters in addition to pay-and-display parking meters. Pay-by-plate parking meters would require a person to enter the vehicle’s license plate to register payment for parking, and would be capable of tracking payment by the vehicle’s license plate, rather than by paper receipt. Before the Department of Transportation (DOT) makes changes to the parking meter rates or replaces a pay-and-display parking meter with a pay-by-plate parking meter, DOT would provide 30-days written notice to the Council Member and Community Board in whose district such change would occur and post such change on the DOT’s website. Additionally, parking time could only be used on the blockface, or street section, for which it was purchased and could not be transferred between blockfaces. This bill would also consolidate existing sections of the Administrative Code related to parking meters into one section.

Summary
The New York Social Services law and Family Court Act require that when a foster care placement changes, a social services agency or worker must provide the attorney for the child with notice of the change in placement. This bill would require the Administration for Children’s Services (ACS) to conduct quarterly audits of foster care placement notifications. The audit would include a review of instances in which a notice was not provided as required, the time elapsed between a change in foster care placement and when the placement notice was provided, when notice of the change was provided to the attorney for the child and a summary of the information that was missing from the notice. ACS would be required to report to the Mayor and the Speaker of the Council, and post on the ACS website, a report with the results of its audit from the preceding quarter.

Summary
The Zoning Resolution established the Inclusionary Housing Program and other affordable housing programs to ensure that the housing marketplace serves New Yorkers at a broader range of income levels. These affordable housing programs promote economic integration in areas of the City undergoing substantial new residential development by requiring a portion of the housing developed be permanently affordable to provide for long-term stability and economic diversity in neighborhoods. This bill authorizes the Department of Housing Preservation and Development to enforce the affordable housing provisions placed within its responsibility in the Zoning Resolution, and provides procedures by which enforcement is to take place. Without this authorization, the city would be limited in its ability to ensure that the Zoning Resolution’s affordable housing programs are serving their purpose and would lack the ability to penalize those who would cheat the system.

Summary
This bill would amend the City’s data breach notification laws to align them with requirements in New York’s SHIELD Act. It would make certain definitions in City law more consistent with State law. City agencies that have suffered a security breach involving persons’ private identifying information would be required to promptly disclose it to the City’s Chief Privacy Officer, the Office of Cyber Command, and the Department of Information Technology and Telecommunications; formerly the NYPD received this type of disclosure. The obligation to make this type of disclosure – including to affected persons – would be expanded to situations in which the information was reasonably believed to have been accessed, disclosed or used by an unauthorized person. With some exceptions, the bill would mandate that if 5,000 or more New York residents must be notified at one time pursuant to Section 10-502 of the City’s Administrative Code, the notifying agency must also notify consumer reporting agencies as to the timing, content and distribution of the notices, and approximate number of affected individuals. Certain agencies would have to coordinate and keep records on data breaches. The bill would mandate that Department of Consumer and Worker Protection, Department of Health and Mental Hygiene and Taxi and Limousine Commission licensees required to make a data breach notification pursuant to State law, promptly submit a copy of the notification to their licensing agencies.

This bill would require the creation of an advisory board to advise the Mayor and the Council on the issue if street harassment prevention. The advisory board would have the duty to:
study the occurrence of street harassment; identify persons and communities most at risk of street harassment; and to develop and recommend: programming and training materials for city agencies to prevent and respond to street harassment; programming, training and educational materials to promote public awareness and prevention of street harassment; forms of support and resources for victims of street harassment; and programming regarding non-criminalization responses to street harassment. By December 31, 2022, the advisory board would be required to make information and resources available to city agencies for posting on their websites. Eighteen months after the local law takes effect, the advisory board would be required to develop a survey with questions that would assess the prevalence of street harassment in the city. By December 31, 2022, the advisory board would be required to produce a report summarizing its activities, and annually thereafter the report would be required to include the findings of the survey the advisory board developed. Members of the advisory board would include the directors of the Commission on Gender Equity and the Mayor’s Office to End Domestic and Gender-Based Violence, the Chair of the City’s Human Rights Commission, and the Executive Director of the Office of Nightlife, among others, and would include appointments by the Mayor, Speaker of the Council, and the Public Advocate. Such members would be required to meet no less than once each quarter, and hold at least one meeting open to the public.

Summary
This bill would extend the certification of no harassment pilot created by Local Law 1 of 2018 until September 27, 2026. Buildings discharged from Article 7-A program, unless such building is the subject of a rehabilitation loan; buildings where a full vacate order has been issued, except where such vacate order was issued due to a fire; buildings where there has been active participation in the alternative enforcement program which have been discharged from such program; buildings where a court or DHCR have made a harassment finding; and buildings indicating significant distress as determined by the Building Qualification Index (BQI) would be required to apply for the CONH for covered work. Interior demolition conducted during renovation of occupied units necessary to protect public health and safety, or repairs, replacement, modification, or partial demolition work in a building that is the minimum required to be performed to address conditions for rescission of a vacate order would not require a CONH. A court may find that acts of harassment that caused the denial of a certification of no harassment constitute harassment and shall in those cases award to each lawful occupant of a dwelling unit that was subject to such harassment $5,000 plus reasonable attorneys’ fees and costs.

This bill would also require the Department of Transportation (DOT) to affirmatively offer a presentation of any such project plan to affected community boards, and would give community boards sixty days following DOT’s presentation of any such project plan to provide recommendations or comments on such plan. Finally, this bill would require DOT to post quarterly progress reports on its website for any proposed major transportation project or installation or removal of a bus lane, busway or bike lane.

HRA would also be required to designate sites at each DOC facility where an incarcerated person may apply for an IDNYC. DOC would be required to facilitate this process by providing assistance in completing the IDNYC application, including written documentation of the individual’s book and case number or a New York State identification number, a photo of the incarcerated person to submit with the application, and a letter stating that the incarcerated person has resided in New York City for at least 15 days and lacks a home address, if applicable. DOC would also be required to notify each eligible person in their custody of their ability to apply for an IDNYC.

The bill would require severance pay for hotel service employees in the event of: 1) the closure of a hotel to the public, provided that the hotel has not, by October 11, 2021, recalled at least 25% of employees and reopened to the public by November 1, 2021; or 2) a mass layoff of at least 75% of employees. Employees eligible for severance pay would be owed $500 per week, for up to 30 weeks. This requirement would not apply to a hotel that has closed permanently and has or is in the process of converting to an alternate use, provided that employees are offered severance of at least 20 days pay per year of service and provided that the severance is specifically tied to the conversion. The obligation to provide severance would end when an employee is recalled, or, for a closed hotel, when the hotel reopens to the public and recalls 25% of employees.

This bill would allow the Department of Housing Preservation and Development (HPD), to accept as proof of occupancy for relocation services, three written statements: a signed statement from the tenant, a notarized statement from someone not in the same household as the tenant but who has personal knowledge of the tenant, and a signed statement from someone who resides in the same unit as the tenant and is receiving relocation services for the same event or if that is not possible, a notarized statement from someone who resides in the same building as the tenant or an adjacent building. In addition, HPD would be required to try to obtain records of the tenant’s address from any government agency identified by the tenant as likely to have those records.

Summary
Pursuant to Local Law 152 of 2016 and Department of Buildings (DOB), rules, between January 1 and December 31 of every fourth year, building gas piping systems must be inspected in community districts in all boroughs. DOB rules also require submission of a certification that all conditions identified in the inspection report have been corrected no later than 120 days, or if more time is needed, no later than 180 days following the inspection date. Currently, inspections conducted under Local Law 152 include exposed gas lines from point of entry up to individual tenant spaces. This bill extends the physical scope of inspection from individual tenant spaces to the point of connection for any equipment that uses gas supplied by gas piping.
