City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

This bill would require that city agencies provide the Council with a copy of the departmental statement of needs for city facilities that is submitted annually to the Mayor. It would also require that real property owners or real estate professionals working on their behalf notify the city 30 days before properties will be listed for sale. The notification would be submitted through a website specified by the Commissioner of Citywide Administrative Services. The website would also track whether any city agency is interested in acquiring the real property. The bill would also preserve the city’s authority to use the uniform land use review procedures or eminent domain to acquire properties if applicable.

This bill would require that the Department of Health and Mental Hygiene undertake a public education campaign in facilities that provide obstetric and gynecological care through the Department to inform patients about the city standards for respectful care at birth, health care proxy forms, the right to be free from discrimination related to pregnancy, childbirth, or a related medical condition, the right to be free from discrimination due to caregiver status, the right to reasonable accommodations in the workplace including lactation accommodations, paid sick and safe leave, temporary schedule changes, temporary disability insurance, the family and medical leave act of 1993 and New York’s paid family leave program. The campaign would distribute posters, flyers, forms and other written material to patients. The bill would also invite the New York City Health and Hospitals Corporation to distribute and post such materials at locations under its jurisdiction.

This bill would require the Department of Parks and Recreation (DPR) to conduct risk and health inspections of every street tree under its jurisdiction that has a caliper size greater than 6 inches at least once between each tree’s pruning cycles. DPR would be required to publicly post the criteria that it utilizes to inspect such trees and submit an annual report on how many trees are referred for inspection each year, how many are actually inspected each year and the results of such inspections. Finally, DPR would be required to maintain a regularly updated map on its website that displays each tree that was inspected, the result of such inspection and the action taken by the DPR in response to the result of such inspection.

Pursuant to Local Law 152 of 2016 and Department of Buildings (DOB), rules, between January 1 and December 31 of every fourth year, building gas piping systems must be inspected in community districts in all boroughs. DOB rules also require submission of a certification that all conditions identified in the inspection report have been corrected no later than 120 days, or if more time is needed, no later than 180 days following the inspection date. This bill would require DOB to create a questionnaire that could be shared with stakeholders and members of the public. Through this questionnaire, DOB could seek feedback on Local Law 152. Starting on March 1, 2022, and on every following March 1, DOB would be required to report to the Council, the Mayor, and post on its website, the results of the questionnaires received during the prior calendar year.

This bill would also require DOT to notify vehicle owners of such affirmative defense.

This bill would amend the definition of the term “veteran” to additionally include persons currently serving in the active military service, regardless of discharge status or time served. The bill would also amend the definition to include those who serve or have served in the United States Public Health Service or as a commissioned member of the National Oceanic and Atmospheric Administration. This bill would also increase the membership of the Veterans’ Advisory Board (VAB) to 13 members, two of whom must be immediate family members, spouses or domestic partners, survivors or caregivers of veterans. The Department of Veterans’ Services (DVS) would also be required to publish, and regularly update, a list of all VAB members on the department’s website including term information and appointing official.

This bill would prohibit third-party food delivery services, entities that provide restaurants with online order and delivery services, from making changes to orders, including the amount a customer is charged or the amount a restaurant will receive, without first consulting the restaurant fulfilling the order. Before a third-party food delivery service makes a change to an order it would first inform the restaurant, then the customer. Additionally, this bill would prohibit third-party food delivery services from charging restaurants more than 50% of the cost of refunding an aggrieved customer for an order unless the customer’s complaint is unrelated to services provided by the third-party delivery business. Failure to comply would result in civil penalties.

This bill would require these services, if listing any telephone number for an establishment, to include that establishment’s direct telephone number, and if also including a unique telephone number, to provide a description of the telephone numbers. The description must identify each type of telephone number and any fees associated with their use. The Commissioner of the Department of Consumer and Worker Protection would be required to promulgate rules defining the content, size and location of the description.

This bill would require the Commissioner of Consumer and Worker Protection to report on all violations of subchapter 22 of chapter 5 of title 20 of the Administrative Code and rules promulgated thereunder. Those provisions regulate certain conduct of third-party delivery services, including by placing a 15% cap on delivery fees levied on restaurants during a state of emergency and banning delivery fees charged for telephone orders during states of emergency. The report will include, but not be limited to, the company name, the date of the violation, the section of law violated, any penalties assessed such as monetary penalties, injunctive relief, or court fees and costs, and the borough where the violation occurred. The Commissioner of Consumer and Worker Protection would also be required to report on presumed violations of these provisions after June 2, 2020, during times when they are not in effect because no state of emergency is in place.

This bill would prohibit third-party food delivery services – defined in this bill as any website, mobile application or other internet service that sells and offers delivery or pickup of food and beverages from a food service establishment owned by another entity – from listing food service establishments on their application or website and making deliveries from such establishments, without a written agreement between the delivery service and the establishment. It would also prohibit the delivery services from requiring the establishments, in these written agreements, to indemnify the delivery service or their independent contractors or agents for certain damage that occurs after food or beverages leave the establishment. Violations of this bill would be subject to a civil penalty of not more than $500 per day per establishment with respect to which a violation was committed. The Commissioner of the Department of Consumer and Worker Protection would be required to conduct outreach about the requirements of this bill.

Summary
This bill would authorize the City Council to adopt by resolution an interest rate between 3 percent and 7.5 percent for qualifying properties with an assessed value of more than $250,000 and no greater than $450,000 and an interest rate between 6 percent and 7.5 percent for qualifying properties with an assessed value of more than $450,000 for the nonpayment of taxes due on July 1, 2021 and paid no later than December 31, 2021 for fiscal year 2022 for real property. To be eligible, property owners would be required to demonstrate to the Department of Finance (DOF) by no later than November 30, 2021 that such property owner either: (a) owns class 2 or 4 real property with an assessed value of more than $250,000 and less than $1,000,000, the income from which declined, for any six month period between March 7, 2020 and June 30, 2021, by at least 50 percent as compared to the corresponding period in the previous 12 month period due to COVID-19, or (b) owns real property where at least 50 percent of the property is used for residential rental dwellings and contains no more than 50 rental dwelling units, of which at least 50 percent are rent regulated accommodations, the income from which declined, for any six month period between March 7, 2020 and June 30, 2021, by at least 25 percent as compared to the corresponding period in the previously 12 month period due to COVID-19. Additionally, DOF would be required to report to the Speaker no later than February 1, 2022 the number of properties for which the lower interest rates was imposed, the total amount of tax due and the total amount of interest reduced, all disaggregated by two qualifying provisions, and the aggregate value of the real property tax liability of those properties. The bill also mandates notice and outreach regarding the program.

This bill would require all third-party food delivery services that serve at least 20 different establishments with different owners or operators to provide estimated times of arrival for all their deliveries. It also would require them to provide an anticipated delivery time that will be expressed in a range of at least five minutes before and after the estimated time of arrival. If the estimated delivery time changes for any reason, the food delivery service must update the customer with a new estimated time of arrival and window of anticipated delivery time that references the original timeframe given. Finally, the bill would require that food delivery apps explicitly state that they are responsible for the delivery once the order leaves the restaurant. A violation would be subject to a civil penalty of $500 for each instance.

A Local Law to amend the administrative code of the city of New York, in relation to inspection of building gas piping systems and extension of time to complete work required by inspection
Summary
Pursuant to Local Law 152 of 2016 and Department of Buildings (DOB), rules, between January 1 and December 31 of every fourth year, building gas piping systems must be inspected in community districts in all boroughs. DOB rules also require submission of a certification that all conditions identified in the inspection report have been corrected no later than 120 days, or if more time is needed, no later than 180 days following the inspection date. Although a late certification is permitted when additional time for a correction is needed, where a property owner is unable to timely complete an inspection, there is no way for the property owner to seek an extension of time to complete the inspection. In addition, a property owner is required to have gas piping in their building inspected, even if the building does not have active gas service. This bill would allow a property owner of a building with gas piping but not active gas service to forego their gas piping inspection so long as they provide certification from their utility company and themselves that there is no active gas service in their building. If they resume gas service they must obtain a certificate of approval of gas installation from DOB and comply with the gas piping inspection and certification requirements of local Law 152. This bill also allows DOB to grant additional time to submit a certification, beyond 180 days, if additional time is needed to ameliorate conditions that must be corrected. Finally, this bill provides a 180 day extension to comply with both the inspection and certification requirements of Local Law 152 for any building owner who requests an extension.
