City Council Legislation: Bills and Local Laws

This dataset contains information on New York City bills from 1998 through 2024.

The New York City Council is the City’s legislative body, responsible for proposing, debating, and voting on legislation that affects all aspects of city governance. The legislative process for Introductions in NYC follows these steps:

Bill Introduced – A bill is introduced by a Council Member and assigned a number.

Committee Hearings – The bill is referred to a committee for review, where public hearings may be held for discussion, public comment, and stakeholder engagement.

Committee Vote – The committee votes on whether to advance the bill to the full Council.

Full Council Vote – If approved by the committee, the bill is voted on by the entire Council. A majority vote is required for passage.

Mayoral Action – Once passed by the Council, the bill is sent to the Mayor, who may sign it into law, veto it, or allow it to become law without a signature. If vetoed, the Council can override the veto with a two-thirds majority vote.

Enactment – Once signed or passed via override, the bill is assigned a local law number and becomes part of the city’s legal code. Bills may be enacted immediately, or upon a date defined in the bill.

This dataset provides information on all introductions, regardless of whether they were enacted.

Summary
This bill would reauthorize the City’s authority to sell tax liens for one year after the enactment of the local law. This bill would also, among other things: 1) create a COVID-19 exemption for calendar year 2021 for certain Class 1, 2 or 4 properties, provided that the property owner owns 10 or fewer units, one of which is the owner’s primary residence, and such owner submits a hardship declaration to the Department of Finance stating that they are experiencing a COVID-related financial hardship; 2) increase the property tax debt eligibility threshold for Class 1 and residential condominium and cooperative properties to $5,000, 3) increase the water debt eligibility threshold for 2- and 3-family homes to $3,000, 4) increase the income eligibility threshold for the Department of Finance’s Property Tax and Interest Deferral (PTAID) Program to $86,400, 5) introduce a process to establish a property tax late payment interest rate for properties with an assessed value between $250,000 and $450,000, 6) mandate certain outreach sessions to be conducted by the Administration during the tax lien sale notice period, and 7) establish a temporary task force to to ensure that the City’s enforcement of delinquent municipal charges is fair, effective, and efficient and to study the feasibility of transferring properties with delinquent property taxes, sewer and water rents subject to a lien to community land trusts, land banks, mutual housing associations or other similar entities.

Summary
Pursuant to Local Law 152 of 2016 and Department of Buildings (DOB) rules, between January 1, 2020 and December 31, 2020, building gas piping systems must be inspected in community districts (CD) 1, 3 and 10 in all boroughs. DOB rules also require submission of a certification that all conditions identified in the inspection report have been corrected no later than 120 days or if more time is needed no later than 180 days following the inspection date. This bill would extend the December 31, 2020 inspection deadline for buildings in CD 1, 3 and 10 in all boroughs to June 30, 2021. The bill provides that for such buildings inspected between September 1, 2020 and December 31, 2020, the certification of correction may be submitted later than 120 days or later than 180 days following the inspection date, as applicable, but no later than June 30, 2021. This bill would also require DOB to conduct targeted outreach regarding the requirements of Local Law 152 of 2016, submit a report describing the methods of targeted outreach employed by the agency, and solicit public comments related to the implementation of Local Law 152 of 2016.

Summary
This bill would create a new violation and civil penalty for hazardous obstruction by a vehicle of a bicycle lane, bus lane when bus lane restrictions are in effect, sidewalk, crosswalk, or fire hydrant when such vehicle is located within a radial distance of 1,320 feet of a school building, entrance, or exit. The proposed legislation imposes a $175 penalty for each such violation. Such violations would be returnable to the Office of Administrative Trials and Hearings (OATH). The proposed legislation would require the Department of Transportation (DOT) to create a civilian reporting program where civilians may submit complaints and supporting evidence for alleged violations to DOT. Where DOT brings a proceeding before OATH using evidence or information submitted by a civilian complainant, OATH would award the complainant 25 percent of any proceeds collected as a result of such proceeding.

This bill would establish a board to review the workplace health and safety guidance that agencies and private employers issued to employees during the COVID-19 pandemic. The board would hold two public hearings a year to solicit testimony from employees, relevant experts, and stakeholders and make recommendations on protocols for future public health emergencies based on an assessment of the testimony and any submitted guidance. The board would consist of 9 members: the Commissioners of Health and Mental Hygiene, Citywide Administrative Services, Consumer and Worker Protection, and Office of Labor Relations; two Mayoral appointees; two appointees by the Speaker of the Council; and one appointee by the Public Advocate. The board would submit a preliminary report after the first hearing and, by December 15, 2021, a final report to the Mayor and Speaker of the Council. The board would dissolve 180 days after submission of the final report.

Summary
Current City rules prohibit restaurants from adding surcharges to listed food and drink prices. This bill would allow restaurants to impose a “Food Service Establishment Surcharge” of up to 15 percent of a customer’s total bill, as long as restaurants pay their tipped workers a cash wage that is not less than the City’s minimum wage of $15 per hour. Tips received by such workers would not be credited towards the hourly cash wage. The surcharge would have to be clearly disclosed on the menu, final bill and receipt, and the disclosure must be explicit that the additional charge is not a gratuity.

This bill would amend the New York City charter to codify Campaign Finance Board (“CFB”) rules, currently enumerated at Title 52, Section 6-04 of the Rules of the City of New York, for determining whether an alleged independent expenditure is in fact made without coordination of any candidate. The bill provides that an expenditure will be presumed to be non-independent where it finances the dissemination of any materials prepared by a candidate, unless such candidate can show that the expenditure was not made with their coordination. The CFB shall otherwise determine whether an expenditure is independent by considering a non-exhaustive list of factors set forth in the bill, as well as by considering any evidence provided by the spender or candidate.

This bill would require the City to create an Open Retail Program that would allow retail establishments to offer outdoor retail to consumers on sidewalks, streets, and other approved open spaces. The Department of Transportation (DOT) would be required to create a self-certification process that indoor retail owners must complete before offering outdoor retail under the program. Such process would not require DOT approval, however, a self-certification could be suspended or terminated by DOT for non-compliance with requirements of the program or for the protection of public health or safety. The program would run until at least December 31, 2020, with the possibility of extension up to December 31, 2021.

This bill would require that, during a public health emergency, the Citywide Office of Occupational Safety and Health would monitor federal, state and city agencies that provide information about occupational safety and health. If any such agency issues guidance about occupational safety and health related to the public health emergency, the Citywide Office of Occupational Safety would be required to email such guidance to the safety and health coordinator at each city agency within 24 hours. Within 24 hours of receipt of such guidance, the safety and health coordinator would be required to post it in the workplace, email it to each employee of the agency and send a summary to each employee that is tailored based on employee’s position to highlight the most relevant information from the guidance. The coordinator would also be required to provide each employee any education or training required to ensure proper compliance with the most recent guidance.

Summary
This bill would require the Inspector General for the Police Department to make public the disciplinary records of leadership in the New York City Police Department by submitting such records to the Council and by posting such records on the Department of Investigation’s website. This bill would also require the Inspector General for the Police Department to review such records and to submit a report to the Council, as well as to post such report on the Department of Investigation’s website, that summarizes instances of substantiated misconduct and related disciplinary measures documented in such records.
