DEP currently jointly owns the dam with SHLPOA and is therefore liable for any costs to improve or maintain the dam. DEP does not need this lake as it is primarily used for recreation. The dam/lake is used by a local community as the dam is only partially owned by DEP and the lake is almost entirely owned by SHLPOA. It is not needed for water supply purposes. Therefore, DEP would like to relieve itself of the costs and responsibilities associated with dam ownership, which can be accomplished with this proposed action.

The action represents an infrastructural enhancement of existing structures whose current use shall primarily remain unchanged. The pier now used as passive recreational open space shall be repaired and continue to be used as such. The floating structure shall not be altered and will continue to be used for cultural programs. The physical improvements to the Fulton Ferry Fireboat House and Hose Shed shall bring these buildings up to code. The 1221 S.F. first floor of the restored Fulton Ferry Fireboat House shall include a small exhibit area and warming kitchen which are expected to be used as linked trips either for the passive open space or the cultural facility. The 1221 S.F. second floor of new office space shall house the 'limited number of administrative personnel for the cultural resources (exhibit space and/or floating structure). Traffic generated by the action is not expected to be appreciably different from current traffic conditions, should be limited to the off-peak hours and draw mostly from the neighborhood. The NYC Landmarks Preservation Commission has approved the proposed improvements to the Fulton Ferry Fireboat House/Hose Shed located within a designated historic district. The Army Corps of Engineers has approved a permit for the repairs to the pier and bulkhead. NYSDEC and NYC Board of Standards and Appeals approvals are also anticipated.

New York City Department of Environmental Protection (DEP) proposes refacing repairs to the downstream face of Cross River Dam. The project is located on Reservoir Road, at the west end of the Cross River Reservoir which serves as a water supply source for the City of New York. Cross River Dam was put into service in 1908. Over the past century, the dam has been exposed to environmental degradation and certain chemical processes within the concrete which has led to wear and deterioration of the exposed surface concrete at the structure. The downstream concrete dam face has deteriorated to the point that steel reinforcement is now exposed and small pieces of concrete a safety concern for DEP staff, contractor personnel, and the general public. However, there is no overall stability with the dam itself.
