Intro. 2349-A. The action is a proposed Local Law in relation to allowing the Department of Sanitation (DSNY) to restore certain permitted capacity at one or more private solid waste transfer stations that elect to utilize rail to transport a majority or all of their waste from the City. The New York City Solid Waste Management Plan favors reducing transfer trailer trucks to transport waste from the City to disposal facilities such as landfills and waste-to-energy plants, and thereby reduce traffic, air and noise impacts to communities from such long-haul transfer trailer truck traffic. The Proposed Action would allow the DSNY to restore certain capacity reductions that were mandated by Local Law 152 of 2018 (§16-498.1 of the New York City Administrative Code) in Brooklyn Community District (CD) 1, Bronx CDs 1 and 2, and Queens CD 12, which are overburdened with transfer stations, provided the facility in question takes specified steps to utilize rail to transport its waste from the City. For a transfer station operator to have its capacity reductions under LL152/2018 restored, it must, among other things, first declare its intent to transport by rail more than half or all of the waste accepted by the transfer station, demonstrate on a site plan that a public street will not be used for more than 1,000 feet to transport such waste between the transfer station and a rail facility, and perform an environmental review, including for any proposed facility modifications needed to utilize rail transport directly from the facility or in proximity to the facility. In addition, the operator must submit a plan and timetable to DSNY by which rail would be used to transport more than 50% of the waste from the facility (based on the restored capacity) within four years. Failure by the operator to comply with these conditions or, after transport by rail has commenced, to achieve more than 50% of waste transport by rail for at least one year would result in reimposition of the LL152/2018 capacity reductions for the facility until the facility achieves at least 50% of waste transport from the facility by rail.
