VThe Applicant (Harbor Light Enterprise) seeks a BSA use variance so that it may complete a partially constructed threestory-and-cellar mixed-use building and operate an eating and drinking establishment in the building's ground floor and cellar, contary to the use regulations for an R2 residential district. The building would have a height of 41.83' at the roof line, or 45.33' at the top of the peaked roof. It would contain 11,072 gsf (4,694 gsf of residential space and 6,378 gsf of commercial space), of which 8,217 sf would count as zoning floor area (zfa), for an FAR of 0.82. (This would include 4,694 sf of UG 2 residential zfa, for a residential FAR of 0.47, and 3,523 sf of UG 6 commercial zfa, for a commercial FAR of 0.35). Lot coverage would be 3,522 sf (35.22%). Two conforming residential apartments would occupy the second and third stories. The ground floor would contain the restaurant's kitchen, 88-seat dining room, and bar area (accommodating 38 persons sitting and standing), as well as the residential entrance. The cellar would contain the restaurant's restrooms and refrigeration and storage space. There would be 20 accessory surface parking spaces accessible via a 15'-wide curb cut onto Beach 130th Street, 65' north of its intersection with Newport Avenue.
